Does The Seller Have To Disclose The Homeowners Association Bylaws And Fees?

Yes, when a property is located in a subdivision or area where a Homeowners Association exists, the seller is responsible to provide a copy of the bylaws and indicate the monthly or yearly fees when listing the property.  Bylaws are established by condominiums and subdivisions for the administration and management of the community.  The bylaws also establish the homeowner’s association, the power given to the board and the responsibilities of each homeowner.  Because the restrictions imposed by the association may not be acceptable to the buyer while the fees will affect the monthly expense he/she will incur, it is critical for the buyer to make an informed decision to be in receipt of this information.
