When listing a property and if there are any concerns or in connection with a new construction, it is important for an agent to verify zoning, property taxes, building codes, building permits, certificates of occupancy and other land use restrictions that may apply or Material Facts.  The local zoning board will have a zoning administrator who will assist the public with such questions.  In addition, additional encumbrances, such as deed restrictions and conditions, regulations of the homeowner’s association, special assessments, or any other condition that would burden the use, enjoyment or disposition of the property need to be disclosed as Material Facts.
