What Is Considered A Fixture?

An item, such as a stove, dishwasher, bookcase, plumbing, track lighting or other attached lighting which was once personal property but has been so affixed to real estate that it has become real property.  If an item is determined to be a fixture, it becomes part of the sale and passes with the property, even though it is not mentioned in the deed.


A seller must deliver all fixtures unless noted as specific xceptions in the contract of sale or the Sellerís Property Disclosure statement.  A broker taking a listing typically inspects the premises carefully and determines with the seller whether any of the apparent fixtures, such as chandeliers (which might be a family heirloom) are considered to be fixtures or should be noted as an exemption in the disclosure document.
